User Agreement

  1. Scope of Application
    This agreement is an agreement between you and Surron New Zealand (hereinafter referred to as "Surron New Zealand" or "we") and its affiliates, regarding your downloading, installation, use, and copying of this software, as well as your use of related services.

  2. Special Notice
    2.1 In order to use this software, you should carefully read (if you are under 18 years old, you should read it with the accompaniment of a guardian), fully understand, and accept the terms of this "User Agreement" (hereinafter referred to as "this Agreement"), especially those relating to the exemption or limitation of Surron New Zealand’s liability, the limitation of user rights, and the methods of dispute resolution, judicial jurisdiction, and applicable law.

2.2 Unless you have carefully read, understood, and accepted this Agreement, you have no right or need to continue to use this software and related services. You can choose to stop using and uninstall this software. If you continue to use this software and related services, it is deemed that you have carefully read, understood, and agreed to be bound by this Agreement. If you do not agree to this Agreement, please uninstall the software after installation.

2.3 This Agreement takes effect when you start using this software or related services and register as a Surron New Zealand user. Please consider carefully whether to accept this Agreement. If you do not accept any term of this Agreement, please immediately stop using all Surron New Zealand services.

2.4 After you accept this Agreement, changes in national policies, products, and the operating environment may require modifications to this Agreement. We will publish the modified Agreement on this software and notify you through prominent prompts, messages, or other means. If you have any objection to the modified Agreement, please immediately stop logging in or using Surron New Zealand products and services. If you continue to log in or use Surron New Zealand products, it is deemed that you have accepted the modified Agreement and agreed to be bound by it.

2.5 If you are under 18 years old, before using this software’s services, you should obtain the written consent of your parents or legal guardians and comply with the relevant laws, regulations, and policies applicable in New Zealand regarding vehicle use and road safety.

  1. Account
    3.1 This software provides a user registration channel. After the user accepts and agrees to this Agreement, they have the right to choose an unused username (which may consist of letters, numbers, or a valid email address) and set a password that meets security requirements. The chosen account and password are the credentials for logging in to this software and receiving its services.

3.2 Registering an account with this software does not imply authorization to use all Surron New Zealand products. It only grants the user the identity to receive the services of this software. Users may need to sign separate product authorization agreements for certain pages, applications, or software.

3.3 The ownership of this software’s accounts belongs to Surron New Zealand. After completing registration, you only gain the right to use the account. This right is non-transferable and limited to the original registrant. Gifting, lending, renting, transferring, or selling the account is prohibited. If we discover or suspect that the current user of an account is not the original registrant, Surron New Zealand has the right to suspend or terminate services to that account without notice and will not be liable for any legal responsibilities. Any resulting losses, including but not limited to interrupted communications or lost data, are borne by the user. The account cannot be inherited.

3.4 Users are responsible for maintaining the security and confidentiality of their accounts and passwords. They are fully responsible for all activities under their accounts and passwords, including modifying data, posting content, and other actions. If a user suspects unauthorized use of their account or any other security vulnerabilities, they should immediately contact our support staff. If the user violates these terms and incurs any loss, Surron New Zealand will not be liable.

3.5 If a user loses their account or forgets their password, they can retrieve the password by using the mobile phone number bound during registration. If the user did not bind a mobile phone number, Surron New Zealand is not responsible for any consequences of inability to recover the account or password.

3.6 Users must ensure the authenticity of the identity information provided during registration. Users are responsible for any consequences arising from the use of false, illegal, or inaccurate information. Users should continuously update their registration information to ensure that it is timely, complete, truthful, and accurate. Surron New Zealand will not be responsible for issues arising from inaccurate or untrue registration information. If a user provides illegal, false, or incomplete information, or posts advertisements, non-serious, or irrelevant content in their profile, Surron New Zealand has the right to suspend or terminate services, cancel the account, and refuse current or future use of this software’s services. All resulting losses are borne by the user.

  1. Scope of Service License
    4.1 You may copy this software only for the purpose of using it and related services. Any backup copies must include all copyright information from the original software.

4.2 All other rights not expressly granted in this Agreement, including any additional rights, are reserved by us. You must obtain our written permission to exercise these reserved rights. Our failure to exercise any right does not constitute a waiver of that right.

  1. Software Acquisition
    5.1 You may obtain this software directly from our official website or from parties authorized by Surron New Zealand.

5.2 If you obtain this software from an unauthorized third party or from an installation program not provided by us, we cannot guarantee that the software will function properly, and we are not responsible for any resulting losses.

  1. Installation and Uninstallation of the Software
    6.1 We may develop different versions of the software for different devices. You should choose the appropriate version to download and install according to your device. This software may have multiple application versions (e.g., iOS, Android). Choose the version that matches your device.

6.2 After downloading the installer, follow the prompted steps for correct installation.

6.3 If you no longer need to use the software or wish to install a new version, you may uninstall the current version at any time.

  1. Software Upgrade
    7.1 To improve user experience and enhance service content, we will continually develop new services and provide updates (which may include replacement, modification, feature enhancements, or version upgrades).

7.2 To ensure the security and consistency of this software and its services, we reserve the right to update the software, change, or restrict certain functions without special notice.

7.3 After a new version is released, older versions may become unavailable. We do not guarantee the continued functionality of older versions or the availability of corresponding customer service. Please check and download the latest version as needed.

  1. Network-related Terms
    8.1 You understand and agree that to provide effective services, this software may use processing power, bandwidth, and other resources of your device. Data charges may apply when using this software, and you should check with your network provider for details. You are responsible for these costs.

8.2 When using certain services of this software, separate agreements or business rules may apply. Please read and agree to the relevant separate agreements before using those services. Your use of these services is deemed acceptance of their separate agreements.

8.3 While we strive to provide secure data storage, we cannot fully guarantee it. For example:

  • We are not responsible for any deletion or storage failure of your data.
  • We may set maximum storage periods and space for your data and may delete data if you cease using the service or if the service is terminated or canceled.
  • We are not obliged to return any data to you after termination of the service.

8.4 You bear certain uncontrollable risks when using this software and its services, including but not limited to:

  • Possible loss or leakage of personal information due to factors beyond our control.
  • Incompatibility issues if you do not choose the correct version for your device.
  • Risks associated with accessing third-party websites and content.
  • Risks if your posted content is shared or reposted by others.
  • Risks related to unstable network signals or bandwidth limitations.
  • Risks of receiving harassing, illegal, or infringing content from others (Surron New Zealand provides no guarantees and is not liable for any resulting damages).
  • Our right to modify, interrupt, suspend, or terminate services without prior notice, without compensation.
  • Risks arising from issues inherent to internet technology and outside human control (e.g., outages, cyber-attacks).
  1. Code of Conduct for Users
    You agree to use this software in a civilized, healthy, and orderly manner. You are responsible for all actions taken under your account. You should exercise judgment regarding all content accessed through the service and assume all risks, including reliance on its accuracy or usefulness. We are not liable for any direct or indirect losses arising from such risks.

Users must comply with all applicable laws and regulations of New Zealand and must not use this software to violate laws, regulations, or the rights and interests of others. If we reasonably believe that a user’s actions (including posted content) violate or may violate applicable laws or any terms of this Agreement, we reserve the right to terminate services without notice.

9.1 Information Content Guidelines
You may not use this software to produce, store, publish, or disseminate content that:

  • Violates any applicable laws, regulations, or public policies of New Zealand.
  • Endangers national security, public order, or public safety.
  • Encourages illegal activity, violence, hate speech, discrimination, or infringes upon others’ legal rights.
  • Is obscene, pornographic, defamatory, harassing, or offensive.
  • Involves the unauthorized disclosure of personal information or infringes on intellectual property or privacy rights.
  • Otherwise disrupts normal software operations or harms other users, Surron New Zealand, or third parties.

9.2 Software Usage Standards
You must not use this software to:

  • Access or interfere with others’ devices, servers, or data without authorization.
  • Spread malicious programs, viruses, or engage in any activities that threaten network security.
  • Reverse-engineer, decompile, or attempt to obtain source code without authorization.
  • Use unauthorized plug-ins, add-ons, or third-party tools that affect the software’s functionality or data integrity.

9.3 Service Operation Guidelines
Unless permitted by law or with our written permission, you must not:

  • Impersonate others or provide false information.
  • Induce other users to click links, share information, or fabricate facts to mislead them.
  • Infringe on intellectual property rights, trade secrets, privacy, or other rights.
  • Engage in any illegal activities using this software.
  • Create, distribute, or operate tools or methods used for violations of this Agreement.
  1. Intellectual Property and Infringements
    10.1 Surron New Zealand holds the intellectual property rights to this software and related products and services. All content is protected by applicable laws and international treaties. You may not use these rights beyond the scope authorized by this Agreement without our written consent.

10.2 Unauthorized use of our intellectual property constitutes infringement.

10.3 By publishing or uploading content via this software, you grant Surron New Zealand a non-exclusive, permanent, sub-licensable license to use, edit, and authorize partners to use this content on any Surron New Zealand service platform.

10.4 If you infringe on others’ rights or violate this Agreement through published content, Surron New Zealand may remove or block such content and take measures against your account (including warnings, restrictions, suspension, or cancellation) without notice. You are responsible for handling third-party claims and compensating any losses incurred by Surron New Zealand.

10.5 If any party believes that content provided through this software infringes their rights, they should file a written complaint with Surron New Zealand along with proof of identity, ownership, and evidence of infringement. Surron New Zealand will handle the matter according to applicable laws.

10.6 We reserve the right to take appropriate legal action against any user violating laws or this Agreement and to report such violations to relevant authorities.

10.7 You are solely responsible for third-party claims arising from your violation of this Agreement, and you agree to compensate Surron New Zealand for any losses incurred.

  1. Terminal Security Responsibility
    Like most internet software, this software may be affected by various factors including user actions, network quality, and external environment. You should protect your personal information, guard your passwords, and remain vigilant against threats such as viruses, malicious software, and cyber-attacks. Surron New Zealand is not liable for losses arising from such factors.

  2. Privacy Protection
    Surron New Zealand values your privacy.
    12.1 Do not disclose sensitive information (e.g., financial details, passwords) while using this software. Any resulting losses are your responsibility.
    12.2 We take reasonable measures to protect user account information.
    12.3 If user information leaks due to factors beyond our control, Surron New Zealand is not liable.
    12.4 You are responsible for any privacy leaks caused by your actions, such as posting private information online.

  3. Third-Party Products and Services
    13.1 If you use third-party products or services provided through this software, you must comply with both this Agreement and the third party’s terms. Disputes with third parties are subject to applicable laws and agreements.

13.2 We may rely on third-party systems or services to support certain features. We do not guarantee the security, accuracy, or effectiveness of third-party content or services. Any disputes or damages arising from third-party services are not our responsibility.

  1. Other Provisions
    14.1 The place of signing this Agreement is deemed to be Auckland, New Zealand.

14.2 This Agreement is established, effective, performed, interpreted, and disputes resolved in accordance with the laws of New Zealand (excluding any conflict of laws principles).

14.3 If any disputes or disagreements arise between you and Surron New Zealand, both parties should first attempt to resolve them through friendly negotiations. If negotiation fails, the dispute shall be submitted to the competent courts of New Zealand.

14.4 The headings in this Agreement are for convenience only and do not affect its interpretation.

14.5 If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions remain in full force and effect.

14.6 This Agreement is drafted in English. Unless otherwise agreed, translations of this Agreement are for reference only and shall not affect the interpretation of this Agreement.
